2. If criminal charges were to be filed, will Poseidon still be able to bring a civil suit? Why or why not?
3. Which courts would likely have jurisdiction - federal or state? Why?

Using information from Problems #1 and #2, answer questions 4 through 7 FULLY and COMPLETELY with support for your positions.
4. Is your report privileged? Why or why not?
5. In which role(s) are you likely to testify if this goes to trial? Support.
6. A. Given what you know about Boscoe, do you think he (you) could qualify as an expert? Why or why not?
B. What specific testimony could you give in this case if you could qualify as an expert that you probably otherwise would not be allowed.
7. Is there anything wrong with the way in which the financial information was obtained? What? Do you think this would affect its admissibility in a criminal trial? What about in a civil trial?
